Step-by-Step Process
Step 1: Execute a Deed of Absolute Sale Ang buyer ug seller mag-sign ug Deed of Absolute Sale. Kinahanglang i-notarize kini sa isang notary public. Step 2: Visit assessor's office bring your Sketch Plan (name of plan must be the buyer), Deed of Absolute Sale, Certified True Copy of the tax declaration and better Tax clearance sa lote. Step 3: Go to BIR: Bring all the documents gikan sa Step 1 and 2
Pay Capital Gains Tax (CGT) at BIR 6% of the selling price or the zonal value, whichever is higher. I-pay sa Bureau of Internal Revenue (BIR) within 30 days from notarization. Pag-late, may penalty! Pay Documentary Stamp Tax (DST) at BIR 1.5% of the selling price or zonal value. I-pay kini kasabay sa CGT sa BIR. May separate BIR form kini.
Step 4: Secure Certificate Authorizing Registration (e-CAR) from BIR After mag-pay sa CGT ug DST, mag-issue ang BIR ug e-CAR. Kini ang proof nga nabayran na ang tanan taxes. Dili ka makasugod sa next steps without this.
Step 5: Pay Transfer Tax at Local Treasurer's Office 0.5% to 0.75% depending on your LGU. I-pay sa Treasurer's Office sa munisipyo o lungsod kung asa naa ang property.
Step 6: Register at the Registry of Deeds Present the Deed of Sale, CAR, Transfer Tax Receipt, ug original TCT/OCT. The Registry of Deeds will issue a new TCT in the buyer's name.
Step 7: Transfer the Tax Declaration at Assessor's Office After makuha ang bag-ong TCT, adto sa Assessor's Office to transfer the Tax Declaration in the new owner's name. Present ang bag-ong TCT ug receipt of payment.
Important Warning
Ang CGT dapat i-pay within 30 days after notarization. Kung mag-lapse kag deadline, may surcharge ug interest pa. Dili ugbok ang mag-prokrastinar dinhi!
